SWITZERLAND: Tribunal Cantonal du Vaud 24 December 1997 Case law on UNCITRAL texts (CLOUT) abstract no. 257 Reproduced with permission from UNCITRAL A Danish seller, plaintiff, delivered furniture to a Swiss buyer, defendant, and commenced a
lawsuit requesting payment of the purchase price. The court did not find it necessary to determine whether the case fell within the scope of the
CISG since both the CISG (article 53) and Swiss domestic law (article 211 of the Swiss Code of
Obligations) led to the same result, namely, that the buyer was bound to pay the price.
(Nevertheless, the action was dismissed for procedural reasons.) APPLICATION OF CISG: Court ruled, not necessary to decide APPLICABLE CISG PROVISIONS AND ISSUES Key CISG provisions at issue: Classification of issues using UNCITRAL classification code
