1978 Draft article 13

(1) An offer becomes effective when it reaches the offeree.

(2) An offer may be withdrawn if the withdrawal reaches the offeree before or at the same time as the offer. It may be withdrawn even if it is irrevocable.

  

CISG article 15

(1) An offer becomes effective when it reaches the offeree.

(2) An offer, even if it is irrevocable, may be withdrawn if the withdrawal reaches the offeree before or at the same time as the offer.


Editorial comments

CISG article 15 and 1978 Draft article 13 are identical except that paragraph (2) of CISG article 15 makes its point in one sentence rather than two. The Secretariat Commentary on 1978 Draft article 13 should therefore be relevant to the interpretation of CISG article 15.
