1978 Draft article 21

A contract is concluded at the moment when an acceptance of an offer is effective in accordance with the provisions of this Convention.

  

CISG article 23

A contract is concluded at the moment when an acceptance of an offer becomes effective in accordance with the provisions of this Convention.


Editorial comments

CISG article 23 and 1978 Draft article 21 are identical except for the substitution of the words "becomes effective" for the words "is effective". The Secretariat Commentary on 1978 Draft article 21 should therefore be relevant to the interpretation of CISG article 23.
