LEGISLATIVE HISTORY

Legislative history of CISG article 62: Match-up with 1978 Draft to assess relevance of Secretariat Commentary

1978 Draft article 58

The seller may require the buyer to pay the price, take delivery or perform his other obligations, unless the seller has resorted to a remedy which is inconsistent with such requirement.

CISG article 62

The seller may require the buyer to pay the price, take delivery or perform his other obligations, unless the seller has resorted to a remedy which is inconsistent with this requirement.

Editorial comments

CISG article 62 and 1978 Draft article 58 are identical except for the reference to "this requirement" rather than "such requirement". The Secretariat Commentary on 1978 Draft article 58 should therefore be relevant to the interpretation of CISG article 62.
