[Suspension of performance: notice obligation]
[Article 71]

In the German literature there is no consensus as to whether the notice of suspension under Article 71(3) is required to justify suspension or is merely an additional duty whose violation does not affect the right of suspension but only entitles the other party to claim damages.[211] The AG Frankfurt am Main held that notice is required to suspend the contract under Article 71 [AG Frankfurt 31 January 1991].[212]
